Next, the victim must show the negligent party caused the accident to occur either by his or her behavior or lack of behavior. Finally, the victim must show that he or she was injured because of the negligent act. These are the essential elements of any tort case. However, there are nuances to each element that is specific to the parties involved and the nature of the accident. In some instances, injury to the victim is not necessary. In some instances, a breach of duty is not necessary.
