Summary Process (Eviction)

Massachusetts does not allow for “Self Help.” This means a landlord must go through the courts to evict a tenant. It is unlawful for a landlord to change locks or force a tenant to vacate without a court order.

Fortunately, while it can be said that Massachusetts Landlord-Tenant Law is tenant friendly, landlords also have rights to ensure their investment remains an investment and not an expensive undertaking. District Courts in Massachusetts have “Supplementary Jurisdiction” to assist in accelerating the eviction process, known as “Summary Process.”

However, if you plan to evict a tenant, you should be prepared for the numerous defenses a tenant may use to stay in the dwelling. Choosing to pursue Summary Process without an attorney can yield delays in the eviction.
