Contract Disputes

A contract is usually an agreement between two parties for performance. The party that does not perform may be “in breach.” Our office can assist you in enforcing a contract provision against another party or assist you in defending an allegation of breach on your part. We strive to end contract disputes by reaching reasonable settlements usually without going to court. However, we are prepared to go to court when the matter cannot be resolved.

In Massachusetts, contracts can be either written or oral. In both instances, the time for bringing a cause of action for contract breach is 6 years. This is known as the Statute of Limitations (“SOL”) for Contracts. Oral contracts in Massachusetts, unlike many states, are treated similarly to written contracts concerning enforceability and the SOL. However, a written contract is always more advisable, and in some instances required for legal enforcement.
