In Massachusetts, in the private sector, most employees are “employees-at-will.” This means an employer has the right to terminate employment without giving a reason. However, there are many conditions when terminating an at-will employee may be unlawful. A well drafted Employee Agreement should be considered prior to hiring an employee in Massachusetts. Importantly, if you have employees, with or without written agreements, you should seek legal counsel on the terms for employment and termination.
